The Website, and Services is owned and operated by ” Odego Freight Dispatch Service LLC “ with Business Address 125 Karri Ln. Unit H, Salisbury, North Carolina 28147. These Terms and Conditions (or “Terms of Use”) govern your use of the site, including related platforms, websites, and networks except where we expressly state that separate terms (and not these) apply, and provide information about the www.odegofds.com Service (the “Service”). When you create an account or use the services, you agree to these Terms.

This Terms of Service (“Terms and Conditions”) also includes our Privacy Policy, Cookies policy and Copyright Policy these also referred to by those agreements, form a whole, which governs any access to the Odego Freight services.   2. Third Party Services. Certain services provided herein may be subject to separate third-party terms of service and/or fees, including, but not limited to, the terms of use and fees imposed by a specific third-party provider (“third-party”) which are your sole responsibility.
  3. Privacy. You consent to our collection, usage and storing of your personal identifiable and non-personal identifiable information in accordance with Odego Freight’s Privacy Policy, including, but not limited to, the collection of your location data such as GPS coordinates.
  4. Messaging. You agree that Odego Freight hold the right to send you messages related to the service, messaging in the context may occur via different electronic communications methods.
  5. No Warranties. You agree that the Odego Freight site and services provided herein are “as is,” without any warranty and our liability to you is limited.
  6. No Violation of Laws. You agree that you will not, use the Site or Service, to violate any ordinance, rule, applicable law, regulation or treaty. Without limiting the foregoing, you agree that you will not make available through the Site or the Service any material or information that infringes any copyright, patent, trademark, trade secret, or other right of any party (including rights of privacy or publicity).
  7. Trademark License

Subject to the express provisions of these terms and conditions. All trademarks, logos, and service marks (“Marks”) displayed on the website www.odegofds.com are the property of Odego Freight Dispatch Service LLC. You re not permitted to use these Marks without our prior written consent.

  1. Description of Service

At Odego Freight we are obligated with you, to book, secure and negotiate rates from brokers on your behalf. We pride are selves on being reliable in planning routes for freight delivery, monitor hours of service, offer quarterly IFTA filings for carriers, manage driver qualification files, and set vehicle automation reminders. Our exclusive enclosed services also includes providing unlimited PSP, CDLIS, & MVR reports and much more. For more information about our services, please see our About us section.

  1. User/Individual

The Services are available only to individuals who can be referred to as carriers or Users 18 years or above of age and can enter into a legally binding agreement under the North Carolina State laws.

  1. Sign Up

You must sign up for an account on the Website in order to access and use the Odego Freight services. when You sign up on the site we will ask for certain personal information to enable our server create an account for you with your details. You agree to provide only true and accurate information about your self.

All information You provide to us during registeration will be treated with utmost secrecy and in accordance with our Privacy Policy, which You are adviced to read carefully also. Once You have completed your account creation, we will send you a confirmation email to the email address you provided to confirm if you are a human.

  1. Hyperlinking

Odego Freight makes no representations about any other web site which you may access through the service. When you access a non-Odego Freight website, you understand that it is independent from Odego Freight, and that we have no control over the content on such site, even if Odego Freight provides information or services about the site. In addition, a link to a non-Odego Freight web site does not mean that Odego Freight endorses or accepts any responsibility for the content or the use of such site. In fact, Odego Freight disclaims any and all liability and responsibility for such content. You agree it is your responsibility to take precautions to ensure that whatever site you hyperlink from our site is free of viruses, worms, trojan horses and other destructive components.

  1. Payments for services

You agree to pay the fees for any services, including a $400(12%), $500(10%), or 600(8%) advance deposit before the initial dispatch, and you consent to make these payment before onboarding and booking loads.

During your payment, you agree and acknowledge that you will provide an accurate and authourize method of payment to complete your purchase i.e. Master Card and Visa Cards. If your payment method fails, you agree that Odego Freight holds the right to suspend the service until payment is processed and approved by Odego Freight.

  1. Service Charge

For the performance of the service provided by Odego Freight, you agree that Odego Freight hold the right to receive an 8%, 10%, or 12% service charge fee per load obtained, depending on the pricing plan you choose and have chosen. The Service charge fee shall be itemized out of the total calculated gross earning for a week. If your payment method fails, you agree that Odego Freight holds the right to suspend the service until payment is processed and approved by Odego Freight.  

  1. Confidentiality

Unless we are authorised by you to disclose information on your behalf, we confirm that where you give us confidential information we shall at all times during and after using the site keep it confidential, except as required by law, by other financial institutions, by our insurers or as provided for in regulatory, ethical, or other professional pronouncements or as part of an external peer review applicable to us or our engagement. This undertaking will apply during and after accessing and using the site.

  1. Location Based Services

We offer some features on the service that enable Odego Freight to tailor each user experience based on their location (“Location-Based Services”). In order to use certain Location-based Services, you agree to allow Odego Freight access your (“Location Data”) through your desired device, including GeoIP, GPS location, or other available mechanisms. You can choose to disable Location-based Services on your device, however, you will not be able to access certain features of the service.

By authorizing Odego Freight to access your Location Data, you agree and acknowledge that

  1. Location Data we collect from you is directly relevant to your use of the Platform;
  2. Odego Freight may, access your Location Data, provide Location Based Services related to your current location; and
  3. Collect store, use, and/or aggregate your Location Data. Please note that most times, location data collected may not be accurate, and Odego Freight disclaims any and all warranties related to any location data and location based services.

Odego Freight may use third party services as part of its Location Based Services e.g. Google Maps. By using our service,  you agree to be bound to the terms of such third-party Location Based Services.

  1. Resource Materials

Some portions of the site may include, or display, content, links, resources, or materials from third parties (“Third Party Materials”). You acknowledge that by using the service, you may encounter third-Party Materials and other content, such as third party advertisements and promotional content (collectively, “Contents”).

Having said that, we only promote those products or services that we have investigated and truly feel provide value to you. Please understand that we are not affiliated with any of these companies in any way neither do we receive any form of compensation for sharing these resource links. If you link to any of these resources, you agree to be responsible for the outcome of such links or services provided therein. You also agree to indemnify Odego Freight of any loss or damages you might encounter in such links.

To be part of a safe and open Service for everyone, you agree to the following:   

  • You can’t impersonate others or provide inaccurate information.
  • You can’t do anything unlawful, misleading or fraudulent or for an illegal or unauthorised purpose.
  • You agree to be atleast 18 years of age, to use or access the service
  • You will not violate (or help or encourage others to violate) these Terms or our policies
  • You can’t do anything to interfere with or impair the intended operation of the Service.
  • You can’t attempt to create accounts or access or collect information in unauthorised ways.
  • You can’t sell, licence or purchase any account or data obtained from us or our Service.
  • You can’t post someone else’s private or confidential information without permission or do anything that violates someone else’s rights, including intellectual property rights (e.g. copyright infringement, trademark infringement, or counterfeit).
  • You can’t modify, translate, create derivative works of or reverse engineer our products or their components.
  • You can’t use a domain name or URL in your username without our prior written consent.

In particular, we will not be liable for:

We respects the privacy of children, and we are committed to complying with the Children’s Online Privacy Protection Act of 1998. This site does not knowingly collect, use, or disclose personal information from children under 18 without prior parental consent. However, we may provide our service to children under 18 years of age but under a parental guardian’s supervision.

  1. Termination

We reserves the right to immediately suspend or terminate the account of any User without warning and notice for violation or breach of any of the agreement in this Terms of Use.

  1. Independent Contractors

You agree that the relationship between you and Odego Freight is that of an independent contractor. You agree that neither you, or Odego Freight, is an employee of the other, or perhaps has or will have any power to bind the other or to create any obligation on behalf of the other, nor shall either represent that it has any such power.

  1. Dispute Resolution

This Terms of Use and the site activities shall be governed in accordance with the laws of the United State of America, without reference to its conflict of law provisions. You agree to submit to the personal and exclusive jurisdiction in North Carolina; United State for any disputes with us arising out of your use of this site. You agree that if a dispute arises, parties will attempt to resolve the dispute with mediation or an online mediation service that is mutually agreed upon by all parties. The parties agree that their good faith participation in mediation is a condition precedent to pursuing other legal remedies. The successful party to any dispute resolution will be entitled to reasonable costs and fees incurred in resolving or settling the dispute, in addition to any other relief to which the party may be entitled.

  1. Place of Jurisdiction

These terms and the relationship between you and Odego Freight is governed by the laws of the Supreme court of North Carolina. If you think the laws fail to satisfy the law of your jurisdiction, we should like to hear from you. However, ultimately it is your choice as to whether you wish to use our website.

  1. Severability

If any provision of these Terms is deemed unlawful, void, or for any reason unenforceable. Then that provision shall not affect the validity and enforceability of the remaining terms.

  1. Your feedback

We encourages you to share your reviews and feedback with us, and we promise to respect your feedback irrespective of the outcome, for it helps us improve on our services and make us serve you better.
